The frequency of errors must remain below a threshold and any error rate above the standard creates a plan of correction. These errors frequently result in patients’ untimely deaths and are potentially compensatory events.

Data showing the verdict range and settlement value of these cases are hard to find since the cases settle before trial. This is generally because these types of cases are binary in nature: either the medication was given in error or not. If so, then there is a settlement shortly thereafter.
